These terms apply when you download, try, buy or use Historia Medica for macOS (the "app"). By buying a license or using the app, you agree to them. In these terms, "we" and "us" mean Dany Innovations LLC, and "you" means the person who buys or uses the app.

Nothing in these terms limits rights you have by law as a consumer where you live.

1. Who you buy from: Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries about payment and handles returns. Your purchase is also subject to Paddle's buyer terms. Paddle collects and pays the sales tax or VAT that applies to your order and sends you the receipt.

2. What you get

Prices are shown on our buy page and at checkout, in your local currency where available. Taxes are calculated by Paddle at checkout.

3. Free trial and beta

4. Refunds

You can get a full refund within 30 days of purchase, for any reason. See the refund policy for how to ask. After a refund, the license key stops working in a later update of the app.

5. License to use the app

The app is licensed, not sold. We grant you a personal, non-exclusive, non-transferable license to install and use it as described in section 2. You may not:

We own the app and all intellectual property in it. The records you enter are yours: we never receive them and claim no rights over them.

If you seriously or repeatedly break these terms (for example by publishing your key, or after fraud or a chargeback), we may cancel your license, and the key will stop working in a later update.

6. Your records and backups

Historia Medica stores your records only on your Mac (see the privacy policy). You are responsible for keeping backups, for example with File → Back Up… and Time Machine. We cannot recover lost data, because we never have a copy of it.

7. Not medical advice

Historia Medica is a personal record-keeping tool. It is not a medical device and does not provide medical advice, diagnosis or treatment. Information it shows, such as reference ranges, trends, suggestions and reminders, may be incomplete or wrong. Always consult a qualified health professional, and never delay or disregard professional advice because of something in the app.

8. Warranty and liability

We work hard to make Historia Medica reliable, but we cannot promise that it will be uninterrupted or error-free, or that it will work with every future version of macOS.

To the extent the law allows, the app is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Also to the extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, and our total liability for any claim about the app is limited to the amount you paid for your license.

Some places do not allow these exclusions or limits. If you live in one of them, they apply only as far as the law allows, and your statutory rights are not affected.

9. Updates and changes to these terms

We may release updates to the app and may update these terms. The current version is always at https://historiamedica.app/terms/ with its effective date. Changes do not reduce what you already bought: your 1.x license keeps covering every 1.x release.

10. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws of your country of residence, and you may bring claims in your local courts.

11. Contact
